These Terms of Service ("Terms") govern the use of this website and the engagement of services offered by Digital Lume ("Digital Lume," "we," "us," "our"), operating from the United Kingdom and providing services internationally.

Digital Lume provides the following services, as described on our website:
The specific scope, deliverables, timeline, and cost of any engagement are set out in a separate signed agreement, proposal, or statement of work agreed between Digital Lume and the client ("the Agreement"). These Terms apply alongside that Agreement. Where the Agreement and these Terms conflict, the Agreement takes precedence.
Ownership of deliverables, code, data, and any other work product produced during an engagement — including who owns what, during and after the engagement — is governed entirely by the individual Agreement signed with each client. These Terms do not assert a default ownership position. Clients should refer to their specific Agreement for these terms, or contact us if anything is unclear before work begins.
Clients are responsible for providing accurate information, timely feedback, and any access, credentials, or materials reasonably required for Digital Lume to deliver the agreed services. Delays caused by incomplete or late information may affect project timelines.
Payment terms, including deposits, milestones, invoicing schedule, and currency, are set out in the individual Agreement for each engagement.
To the fullest extent permitted by law, Digital Lume's total liability arising out of or in connection with any engagement is limited to the total fees paid by the client for the specific engagement giving rise to the claim. Digital Lume is not liable for indirect, incidental, or consequential losses, including loss of profits, revenue, or data, except where such liability cannot be excluded by law.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
Digital Lume treats client information shared during an engagement as confidential and will not disclose it to third parties without consent, except where required by law. Publicity, case studies, or public reference to a client engagement will only be made with the client's explicit agreement.
Either party may terminate an engagement in accordance with the terms set out in the individual Agreement. In the absence of specific termination terms in the Agreement, either party may terminate with written notice, with payment due for work completed up to the termination date.
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or an engagement with Digital Lume are subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise agreed in a specific client Agreement.
Digital Lume may update these Terms from time to time, including to reflect UK company registration once complete. The current version will always be available on this website.
